Glebe Farm Kilvington

This is an application for planning permission for a single house to replace the existing one on the site.  You can view and download full details about the application at the NSDC planning portal (opens in a new window).

The application is not at present proceeding and has been invalidated by the Council.  It was found that the applicant did not own all the land covered by the application.  It is legal to apply for planning permission for someone else's land.

When applying for planning permission the applicant must either:-

  • Certify that it owns all the land covered by the application; or
  • Serve the actual owner.

In this case the applicant certified that it owned all the land.  However part of the site is registered to British Gypsum at the Land Registry.  The applicant's certificate was therefore factually incorrect in law.  The applicant however did not wish to serve the landowner.  It is understood that the applicant claims title by 12 years adverse possession (squatters rights) in respect of the part of the site which it does own.

The view of the Parish Meeting was that the application was acceptable.  This view was communicated to the Council.  However the Parish Meeting's view was formed before the ownership problem was known.
